In a phone conversation on Tuesday, Apple Bistro owner Jennette Waldow told the Business Journal that she plans to appeal the temporary injunction because it was issued “unlawfully.”
She stated the court didn’t follow the correct sequence of events for such an order. The injunction was served during a hearing and had already been signed by the judge and dated, which she said shouldn’t have been possible if it had been carried out properly.
“If they aren’t following the law, it’s null and void,” Waldow said.

Despite the latest injunction, Apple Bistro appears to still be operating. Representatives of the restaurant were fielding calls on Wednesday and a message machine states that the establishment continues to be open daily from 5 a.m. to 5 p.m.
