{"id":8412,"date":"2018-10-22T18:13:42","date_gmt":"2018-10-23T01:13:42","guid":{"rendered":"http:\/\/www.newsmolo.com\/EDC\/2019\/?p=8412"},"modified":"2025-12-20T18:14:20","modified_gmt":"2025-12-21T02:14:20","slug":"ag-rates-lawsuit-to-be-dismissed","status":"publish","type":"post","link":"http:\/\/www.newsmolo.com\/EDC\/2019\/2018\/10\/22\/ag-rates-lawsuit-to-be-dismissed\/","title":{"rendered":"Ag Rates Lawsuit to be Dismissed"},"content":{"rendered":"<p><em>EID]<\/em><\/p>\n<p>Placerville, Calif. \u2014 Earlier this year, EID customer Darwin Throne brought a lawsuit against the District contesting the validity of EID\u2019s water rates.<\/p>\n<p>At its meeting on October 22, 2018, the EID Board of Directors voted to approve a settlement agreement. Under the terms of the settlement, Mr. Throne has agreed to dismiss his lawsuit against EID in exchange for the District\u2019s commitment that each party will bear its own costs, including attorney\u2019s fees, incurred to date in the case.<\/p>\n<p>\u201cWe are glad that Mr. Throne has decided to walk away from this lawsuit,\u201d said EID General Manager Jim Abercrombie. \u201cThe District has been confident in the legality of the cost-of-service study undertaken in 2010\/2011\u2014a study conducted by independent experts and advised by a community-based panel\u2014as well as the subsequent rate implementation. EID has strongly maintained throughout that its water commodity charges are valid under the law and consistent with the requirements of Proposition 218.
